CAN-SPAM Act of 2003
The CAN-SPAM Act has seven main requirements that email marketers must follow:
- Don’t use false or misleading header information.
- Don’t use deceptive subject lines.
- Identify the message as an ad.
- Tell recipients where you’re located.
- Tell recipients how to opt out of receiving future email from you.
- Honor opt-out requests promptly.
- Monitor what others are doing on your behalf.

Problem
- Most firms have controls in place to make sure their Advisors are conforming to the CAN-SPAM requirements.
- However, the unsubscribe requirements are generally only applied to the platform (email marketing, event management, CRM, Webinar) the Advisor is currently using.
- When an Advisor uses more than one platform, the Advisor should regularly synchronize the list of unsubscribed emails so that they do not accidentally violate the CAN-SPAM requirements.
- While most firms require Advisors to synchronize their unsubscribe lists across platforms, because it is not easy, many Advisors fail to fulfill that requirement.
